A prominent Yale law professor traces the development of the U.S Constitution from the beginning in practice and in the many ways it is interpreted. While a Constitutional Scholar, he believe that ultimately the values implied in the Constitution should provide guidance for its interpretation.
We need new scholarship that breaks free of the methodological constraints that I have imposed on myself in this project. While this book has focused on the written and acted Constitution, I myself do not believe that all of American constitutionalism can be deducted simply from the document. At key points the text itself seems to gesture outward reminding readers of the importance of unenumerated rights above and beyond texturally enumerated ones. (P 477)
